This Agreement comprises the entire agreement between you and MBE and supersedes all prior or contemporaneous negotiations, discussions or agreements, if any, between the parties regarding the subject matter contained herein. This Agreement is personal to you and you may not transfer, assign, or delegate this Agreement to anyone without the express written permission of MBE.
 
WINE SPECIFIC CONDITIONS
Unless you are 18 years or older do not use this website for the purposes of attempting to procure alcohol. You must be 18 years of age or older, to order or receive alcoholic beverages from MBE. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. We makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 18. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from MBE is over the age of 18. A person under the age of 18 years cannot accept delivery of alcohol sold online, by phone, fax or mail order. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 18, MBE will prosecute you to the full extent allowable by law. If the person receiving the wine is unable to produce appropriate ID, our couriers will be unable to leave the wine.

Your order is an offer to buy from Mount Benson Estate. There will be no contract of any kind between you and MBE unless and until we accept your order, and MBE shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control in connection with the performance of this Agreement.

All transactions are processed in Australian Dollars. Online orders are by credit card only. We accept Visa or MasterCard. No minimum purchase is required, however delivery costs can be high for small quantities. Australia Post is the MBE carrier of choice. Standard delivery is provided by Australia Post at current market rates. Currently we do not deliver via express post or internationally, but we will make arrangements if possible. We would be bound by international transportation rules & regulations that differ depending on the country.

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. MBE is not responsible for, nor will it replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
